IN NO EVENT SHALL Web Hosting Results BE LIABLE TO APPLICANT OR ANY OR APPLICANT’S CUSTOMERS OR ANY OTHER PERSON, FIRM OR ENTITY IN ANY OTHER RESPECT, FOR DIRECT, INDIRECT, CONSEQUENTIAL,SPECIAL, INCIDENTAL, ACTUAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS OF ANY KIND OR NATURE WHATSOEVER, EVEN IF FORESEEABLE, ARISING OUT OF ANY MISTAKE, ACCIDENT, ERROR, OMISSION, INTERRUPTION, OR DEFECT IN TRANSMISSION,OR DELAY ARISING OUT OF OR RELATING TO THE SERVICES OR THE OBLIGATIONS OF Web Hosting Results PURSUANT TO THIS AGREEMENT AND ANY EXHIBITS OR SCHEDULES HERETO INCLUDING, WITHOUT LIMITATION, (i) ANY FAILURE TO PROVIDE TIMELY OR ACCURATELY PROVISION ANY Web Hosting Results SERVICE, OR (ii) ADVERSE CONDITIONS WHICH MAY RESULT FROM ACTIONS BY REGULATORY OR JUDICIAL AUTHORITIES. Web Hosting Results’S ENTIRE LIABILITY FOR ANY CLAIM OR LOSS, DAMAGE OR EXPENSE FROM ANY CAUSE WHATSOEVER, EXCEPT FOR THOSE ARISING FROM OR IN CONNECTION WITH Web Hosting Results’S GROSS NEGLIGENCE, SHALL IN NO EVENT EXCEED THE MONIES ACTUALLY PAID TO Web Hosting Results UNDER THIS AGREEMENT BY APPLICANT FOR THE SPECIFIC SERVICES THAT GIVE RISE TO THE CLAIM. NO ACTION OR PROCEEDING AGAINST Web Hosting Results MAY BE COMMENCED MORE THAN ONE YEAR AFTER THE SERVICES ARE RENDERED. THIS SITE AND IT'S CONTENT ARE DISTRIBUTED ON AN "AS IS, AS AVAILABLE" BASIS. WE MAKE NO GUARANTEES AS TO RESULTS THAT CAN BE OBTAINED.

The failure of either party to enforce or insist upon compliance with any of the provisions of the Agreement or the waiver thereof, in any instance, shall not be construed as a general waiver or relinquishment of any other provision of this Agreement.

Any disputes that may arise under this Agreement shall be resolved in accordance with the laws of Wyoming. Each party agrees that jurisdiction and venue for any and all disputes under this Agreement will be proper in the District of Wyoming, United States, and that the establishment of such jurisdiction and venue shall be determined by Web Hosting Results.
